Cary is a Partner at Beard Winter LLP. He completed a degree in political science at McGill University in 1996 and obtained his law degree from Osgoode Hall Law School in 1999. He was called to the bar in Ontario in 2001 and has been practising insurance, civil litigation, cyber/privacy law in downtown Toronto ever since. Cary has appeared before the Ontario Court of Appeal, Director Delegate Appeals, Divisional Court, Superior Court, Financial Services Commission of Ontario, License Appeals Tribunal, Canadian Pension Appeal Board Tribunal, as well as other administrative tribunals.
Cary maintains a varied practice which includes defence and plaintiff civil litigation including tort actions, accident benefits claims, commercial general liability, cyber law, privacy law, coverage opinions, property/business loss claims, contract disputes, and commercial litigation. Cary has also been retained to provide expert opinions regarding legal professional negligence claims. Cary has been interviewed by legal trade newspapers such as the Law Times for his expert view of law related matters and is a published author in legal industry journals such as Without Prejudice. He has been a guest speaker at continuing legal education seminars and routinely presents to clients at internal conferences.
Cary is the author of the Beard Winter Defender newsletter that addresses wide-ranging insurance related topics. The quarterly publication, now in its 10th year, has a following of approximately one thousand insurance/business professionals and lawyers. Cary’s articles in the Beard Winter Defender are often cited as a reference in legal articles and used as resource material in post-secondary education.
Cary also has a specialty working with insurers and businesses in the area of cybersecurity and privacy law. His specialty experience dealing with all facets of the insurance industry ranging from evaluating damages claims, coverage, and liability gives him a unique skillset in the fast growing cyber security and privacy law niche market. He provides advice on addressing cyber security pre and post breach as well as privacy law concerns. As a civil litigator, he provides representation in regulatory investigations and litigation. He is a member of the International Association of Privacy Professionals (IAPP) and in the process of certifying to be a Certified Information Privacy Professional \ Canada (CIPP\C). Cary is a member of the Ontario Bar Association Privacy and Access to Information Section as well as the Insurance Law Section.
As a civil litigator, Cary frequently attends at Court and Arbitration. Over the past four years, he has attended multiple jury trials, arbitrations, the Ontario Court of Appeal, numerous Director’s Delegates appeals, Divisional Court, summary judgment motions, and other complex legal motions in both Superior Court and the administrative realm.
