Our client objected to the accounts as presented by the Applicant, in her capacity as Attorney for Property of her late mother. The Applicant sought reimbursement of expenses in the amount of $89,102.07 and compensation in the amount of $10,904.13. The claimed expenses were not property documented and reduced to $31,989.47. The Court found that the Applicant lacked the required care and responsibility with respect to her duties as a fiduciary and her compensation was reduced to $6,000. The Applicant was also ordered to repay $62,500 to the Estate improperly withdrawn from the mother’s account while she was acting as a fiduciary.
